Talent Direct is operated from Scotland and provides a digital platform for talent visibility and connection.

Talent Direct is a digital talent connection platform.

The App allows users to:

• create and manage a profile
• present skills, experience or availability
• browse other profiles (subject to permissions)
• express interest or make contact through the App

Talent Direct does not:

• act as an employment agency, recruiter or employment business
• guarantee interviews, work, placements or outcomes
• employ, contract or engage users
• participate in negotiations or hiring decisions

Any engagement, communication or agreement takes place directly between users, at their own discretion and risk.

To use Talent Direct, you must:

• be at least 18 years old
• be legally capable of entering a binding contract under Scots law
• provide accurate and up-to-date information

We reserve the right to suspend or restrict access where these conditions are not met.

Accounts are created through secure authentication systems.

• You are responsible for safeguarding your login details.
• You are responsible for all activity carried out under your account.
• You must not allow third parties to access your account.

We may suspend or terminate access where misuse, security risk or breach of these Terms is reasonably suspected.

You agree not to:

• provide false, misleading or impersonated information
• misuse the App for unlawful or unethical purposes
• harvest, scrape or copy platform data
• attempt unauthorised access to systems or accounts
• harass, threaten or abuse other users
• use the App for spam, solicitation or deceptive activity

We reserve the right to remove content or restrict access where these rules are breached.

• You retain ownership of content you submit to Talent Direct.
• You grant us a limited, non-exclusive licence to display your content within the App for its intended purpose.
• You are responsible for ensuring your content is lawful, accurate and appropriate.
• We do not verify user claims and make no guarantees regarding the accuracy or completeness of user-submitted content.

Where paid features or subscriptions are offered:

• prices are displayed clearly before purchase
• payments are processed securely by third-party providers
• access is granted immediately following successful payment

Unless otherwise stated, fees are non-refundable once access has been provided.

We aim to provide a reliable service but do not guarantee:

• uninterrupted availability
• permanent access to specific features
• that the App will remain unchanged

We may modify, suspend or discontinue parts of the App at any time.

All software, branding, layout and platform content (excluding user-submitted content) is owned by or licensed to Kelloch Consultancy.

You may not copy, reverse-engineer or commercially exploit any part of the App without prior permission.

Personal data is processed in accordance with:

• the UK General Data Protection Regulation (UK GDPR)
• the Data Protection Act 2018
• our published Privacy Policy

You should review the Privacy Policy for full details of how your data is handled.

Talent Direct is provided "as is" and "as available".

We make no warranties that:

• connections or outcomes will occur
• opportunities will be offered
• user information is accurate
• use of the App will lead to employment or engagement

Use of Talent Direct is at your own risk.

To the fullest extent permitted by Scots law:

• we are not liable for indirect, incidental or consequential losses
• we are not liable for disputes or agreements between users
• we are not liable for loss of opportunity, income or reputation

Our total liability shall not exceed:

• the amount paid by you to use the App in the preceding 12 months, or
• £100, whichever is greater

Nothing in these Terms limits liability where it cannot be excluded under law.

You agree to indemnify and hold harmless Kelloch Consultancy from any claims, losses or liabilities arising from:

• your misuse of the App
• your breach of these Terms
• your interactions with other users

We may suspend or terminate access immediately where:

• these Terms are breached
• misuse or harm is suspected
• required by law or regulatory obligation

Termination does not affect accrued rights or obligations.

We may update these Terms from time to time.

The current version will always be available within the App.

Continued use after changes constitutes acceptance.

These Terms are governed by and construed in accordance with the laws of Scotland.

The courts of Scotland shall have exclusive jurisdiction to settle any dispute arising out of or in connection with these Terms or your use of Talent Direct.
