Recruiter-Specific Rules

These Recruiter-Specific Rules apply to all users accessing Talent Direct in a recruiter, employer or organisation capacity ("Recruiters").

By using Talent Direct as a Recruiter, you agree to comply with these rules in addition to the main Terms and Conditions.

1. Purpose of Recruiter Access

Talent Direct provides Recruiters with controlled access to talent profiles for the purpose of:

  • identifying potential candidates
  • expressing interest in individuals
  • initiating contact through approved platform features

Recruiter access is granted to support ethical, proportionate and respectful engagement with talent.

2. No Employment Agency Relationship

Recruiters acknowledge that:

  • Talent Direct is not an employment agency or employment business
  • Kelloch Consultancy does not act on behalf of Recruiters or candidates
  • all hiring decisions, communications and agreements are made independently

Talent Direct is a connection platform only.

3. Access Controls and Permissions

Recruiter access may be:

  • limited, tiered or conditional
  • subject to approval, review or withdrawal
  • restricted by profile visibility, messaging limits or usage thresholds

We reserve the right to:

  • grant, refuse or revoke recruiter access at our discretion
  • change access levels without notice where misuse or risk is identified

4. Acceptable Recruiter Conduct

Recruiters must:

  • engage professionally and in good faith
  • respect candidate preferences, boundaries and visibility settings
  • provide accurate and honest information about opportunities
  • comply with all applicable UK employment, equality and data protection laws

Recruiters must not:

  • scrape, copy or harvest candidate data
  • attempt to bypass messaging or contact controls
  • contact candidates outside the platform without permission
  • misrepresent roles, organisations or intent
  • spam, pressure or repeatedly contact candidates
  • share candidate data with third parties without lawful basis

5. Data Protection Responsibilities

Recruiters are independent data controllers for any personal data they receive.

Recruiters agree to:

  • process candidate data lawfully and fairly
  • use data only for legitimate recruitment purposes
  • store data securely
  • respect data subject rights under UK GDPR

Talent Direct is not responsible for Recruiter data handling outside the platform.

6. No Circumvention

Recruiters must not attempt to:

  • extract emails, phone numbers or personal identifiers
  • move conversations off-platform without consent
  • recreate or mirror the Talent Direct database
  • use automation, bots or scraping tools

Any attempt to circumvent platform controls may result in immediate termination.

7. Complaints and Misuse

Candidates may report Recruiter behaviour.

We reserve the right to:

  • investigate complaints
  • suspend or remove recruiter access
  • permanently block organisations or individuals
  • share information with regulators or authorities where legally required

Decisions are final and made to protect platform integrity.

8. Fees and Commercial Use (If Applicable)

Where Recruiter access is paid or tiered:

  • fees grant access only, not guaranteed outcomes
  • fees are non-refundable once access is granted
  • misuse voids access without refund

9. Termination of Recruiter Access

Recruiter access may be terminated where:

  • these rules or the main Terms are breached
  • candidate trust is undermined
  • platform misuse is detected
  • required by law or regulation

Termination may be immediate and without prior notice.

10. Governing Law

These Recruiter-Specific Rules are governed by the laws of Scotland, and disputes fall under the exclusive jurisdiction of the Scottish courts.
